SB11-054 Summary

• Amends Colorado law to authorize peace officers to arrest persons without a warrant based on probable cause that the person is an unlawfully present alien meeting specific criteria

• Allows arrests of aliens who are subject to a removal order issued by an immigration court or a detainer/notice of action issued by the federal Department of Homeland Security

• Permits arrests of aliens who have been indicted for or convicted of one or more aggravated felonies as defined by 8 U.S.C. § 1101(a)(43)

• Authorizes arrests of aliens who have willfully failed to register with the federal government pursuant to 8 U.S.C. § 1301

• Requires immigration-related arrest provisions to be interpreted consistent with federal immigration law and implemented in compliance with federal law, civil rights protections, and constitutional privileges and immunities
