Prohibits the Colorado Department of Transportation from requiring property owners to pay for state highway improvements as a condition of receiving an access permit for constructing, reconstructing, or relocating driveways unless otherwise required by federal law or regulation

Requires written concurrence from the appropriate local authority stating that the highway improvement is necessary and that the property owner should pay for such costs

Applies to improvements including auxiliary lanes needed for vehicular access to or from any state highway

Effective 90 days after final adjournment of the 2011 general assembly (August 10, 2011), or if subject to referendum petition, upon approval by voters at the November 2012 general election
