Qualifying utilities serving 40,000+ customers must maintain energy consumption data for all commercial buildings starting January 1, 2012, in a format compatible for uploading to the EPA's Portfolio Manager.

Building owners and utilities must upload energy consumption data to Portfolio Manager beginning January 1, 2013, to generate energy performance ratings.

Disclosure of energy performance ratings to purchasers and lessees is required in two phases: buildings over 50,000 square feet starting January 1, 2012, and all commercial buildings starting January 1, 2013.

Building owners or operators must disclose energy performance ratings in writing at time of conveyance and upon request to prospective buyers, lessees, or lenders.

Willfully or knowingly providing false information in connection with energy performance rating disclosures constitutes a Class 1 misdemeanor; the Real Estate Commission may develop standardized disclosure forms.
