Creates the mistreatment of at-risk adults by caretakers database in the Colorado Department of Human Services to track substantiated allegations of mistreatment by caretakers.

Investigating agencies must determine if allegations are substantiated by preponderance of evidence and forward caretaker names to the database; caretakers receive written notice and have a right to appeal before placement.

Employers may check the database before hiring caretakers and may hire a caretaker even if listed unless the substantiated allegation meets state board-defined criteria that bar employment.

Provides civil immunity to investigating agencies, the state board, and employers relying on database information unless they know the information is false or act with reckless disregard.

Database implementation is contingent on the state department receiving sufficient gifts, grants, donations, or federal moneys by June 30, 2012 to cover implementation costs; without adequate funding, the section is repealed effective July 1, 2012.
