HB 12-1003: Authorization of Graywater Use

• Declares water conservation and reducing per capita potable water demand as state priorities, identifying graywater systems as a strategy to improve water efficiency in residential, commercial, and industrial facilities.

• Defines "graywater" as wastewater from sources other than toilets, urinals, kitchen sinks, nonlaundry utility sinks, and dishwashers collected in buildings that meets water quality control commission standards.

• Authorizes the water quality control commission to adopt control regulations establishing requirements, prohibitions, and standards for graywater use that protect public health and water quality.

• Allows counties and municipalities to authorize graywater use within their jurisdictions, with exclusive local enforcement authority over compliance with state control regulations.

• Specifies that graywater may only be applied to uses allowed by well permits and water rights, with such uses deemed to not cause water injury; repeals obsolete health board graywater provisions.
