HB 12-1018 Summary

• Modifies affiliation rules for social security employers with the Fire and Police Pension Association (FPPA) by changing the provision from allowing future elections to recognizing only elections made prior to January 1, 2007.

• Allows counties participating in the social security supplemental plan to also elect coverage under the statewide death and disability plan by filing a resolution with the FPPA board.

• Clarifies that nothing in the law affects employers' ability to terminate social security coverage or the procedures for such termination.

• Updates disability and survivor benefit provisions in sections 31-31-803, 31-31-807, 31-31-807.5, and 31-31-808 to remove references to local defined benefit retirement pensions selected under section 31-31-704 (3).

• Takes effect at 12:01 a.m. on August 8, 2012 (ninety days after final adjournment), subject to potential referendum petition by voters.
