• Prohibits school districts, charter schools, and institute charter schools from penalizing students whose parents refuse to allow participation in all or part of statewide assessments administered under sections 22-7-409 or 22-7-1006.

• Defines prohibited penalties to include withholding graduation credits, denying diplomas, excluding students from educational programs or extracurricular activities, and preventing advancement to subsequent grade levels.

• Requires schools to inform parents before administering assessments that parents have the right to refuse to allow their child to participate.

• Prevents the Colorado Department of Education from lowering a school's accreditation attainment level or otherwise penalizing schools due to parents' refusal to allow student participation in assessments.

• Does not prohibit schools from enforcing compulsory attendance requirements under Colorado law.
