Board of directors for nonprofit cemetery corporations must include at least one director who owns a lot, grave space, niche, or crypt, with a requirement to maintain the vacancy until such an owner can be appointed.

Nonprofit cemetery corporations must keep annual written reports, bylaws, board meeting minutes from the past three years, IRS Form 990 reports, and current financial statements available for inspection by cemetery lot owners upon reasonable request.

Cemetery lot owners may request electronic or physical copies of required reports, which must be provided within seven days at a cost not exceeding 25 cents per page for paper copies, with no charge for electronic copies.

Lot, grave space, niche, and crypt owners may attend board of directors meetings with reasonable advance notice, but cannot participate without chairperson permission.

Effective date is August 8, 2012, or subject to voter approval if a referendum petition is filed during the ninety-day period after final adjournment of the general assembly.
