HB 12-1087 Summary

• Creates an online animal abusers registry within the Department of Public Safety to publicly list identities of persons convicted of animal cruelty, cruelty to service animals, aggravated animal cruelty, or animal fighting.

• Requires convicted animal abusers (age 18+) to register electronically or in person within 5 business days of conviction, submitting name, aliases, residential address, and a front-facing photograph.

• Registry administrator confirms conviction information upon receipt and includes registrants for 5 years before automatic removal; registrants must notify the registry within 3 business days of any address change.

• Requires the executive director to contract with a nonprofit agency to create and maintain the registry, with the nonprofit bearing all costs; if no nonprofit can be identified, the registration requirements do not apply.

• Failure to comply with registration requirements constitutes a Class 2 misdemeanor; act takes effect 90 days after final adjournment of the 2012 general assembly, subject to voter approval if a referendum petition is filed.
