Extends the right to use deadly physical force against unlawful intruders to include owners, managers, and employees of places of business, in addition to dwelling occupants.

Allows deadly force when an intruder has made an unlawful entry and the person reasonably believes the intruder has committed or intends to commit a crime beyond the trespass, and might use physical force against occupants.

Grants immunity from criminal prosecution and civil liability to dwelling occupants and business owners, managers, or employees who use force in accordance with these provisions.

Amends the premises defense statute to clarify that deadly force may be used under the circumstances described in the new section 18-1-704.5 or when preventing first degree arson.

Takes effect at 12:01 a.m. on August 7, 2012, unless a referendum petition is filed, in which case it requires voter approval at the November 2012 general election.
