HB12-1113: Procurement Preferences Summary

• Creates 3% bid preference for state construction and services contracts exceeding $500,000 if at least 90% of employees are Colorado residents, with additional 1-2% preferences for offering health care and retirement benefits or apprenticeship access.

• Establishes 2.5% veterans' preference for contracts awarded through competitive sealed bidding, best value bidding, or competitive sealed proposals, applicable to Colorado residents who served in any branch of the U.S. armed forces under honorable discharge.

• Requires veteran business certification through the Department of Personnel, mandatory notification of ownership changes within 30 days, and allows 12-month certification revocation for non-compliance with 5% maximum civil penalty.

• Implements penalties including permanent prohibition from state contracts for material misrepresentation or fraud in obtaining preferences, with appeal rights to the executive director.

• Takes effect July 1, 2012, and applies to all invitations for bids or requests for proposals issued on or after that date.
