Special districts must notify county commissioners before furnishing domestic water or sanitary sewer service in unincorporated territory in counties that have not previously approved the district's service plan.

County commissioners have 45 days to review the notification and may require a public hearing; the district must provide requested information and data or the board may delay the hearing.

County commissioners must provide public notice at least 45 days before approval and allow property owners 40 days to request exclusion from the proposed service area.

Requirements do not apply when services are provided only to private property owners by written agreement, within other governmental entities by intergovernmental agreement, for storm drainage/sewer services, or where service area extension was previously approved by the county.

County commissioners must approve or deny the proposed action within 120 days of any public hearing.
