HB 12-1310: Criminal Proceedings Omnibus Changes

• Establishes admissibility of commercial packaging labels and package listings as prima facie evidence of contents in criminal proceedings, with court determination of packaging authenticity.

• Modifies earnings garnishment and attachment procedures for court assessments (fines, fees, costs, restitution, surcharges), giving priority over other garnishments except child support writs.

• Creates Correctional Treatment Cash Fund (renamed from Drug Offender Surcharge Fund) with Correctional Treatment Board to allocate resources for substance abuse assessment, treatment, and recovery services across criminal justice populations.

• Expands deferred sentencing and adjudication periods for sex offenses and unlawful sexual behavior: up to two years for juveniles with extension to five years, and up to two years for adults with consent.

• Defines and criminalizes cathinones ("bath salts") as controlled substances: Class 1 misdemeanor for possession, Class 3 felony for distribution, with enhanced penalties when distributed to minors, plus civil penalties of $10,000-$500,000.
