Effective July 1, 2012, state agencies and governmental bodies must grant a 3% preference to contractors certifying that at least 90% of employees performing work on contracts worth over $1 million are Colorado residents.

For construction contracts, eligible contractors receive an additional 1% preference if offering health care and retirement benefits, and an additional 1% preference if employees have access to a federally qualified apprenticeship training program.

For services contracts, eligible contractors receive an additional 2% preference if offering both health care and retirement benefits to all employees performing the contract work.

Contractors must certify their eligibility for preferences, and agencies may verify compliance through substantiating documentation; noncompliant contractors are ineligible and cannot use preferences to satisfy minimum contract requirements.

The Department of Personnel must promulgate administrative rules for implementation, with an appropriation of $62,767 and 0.9 FTE for fiscal year 2012; preferential treatment does not apply if compliance would deny or preclude federal funding.
