SB12-039 Summary

• Requires applicants under 18 years old seeking an instruction permit or minor driver's license to submit a signed affidavit attesting they have not used illegal drugs or alcohol during the previous year

• The affidavit must be signed by both the applicant and a parent, stepparent, grandparent with power of attorney, guardian, or spouse age 18 or older, or another responsible adult willing to verify the statement

• For foster children, foster parents, guardian ad litem, or designated county/state officials may sign the affidavit if the parent or foster parent is unwilling or unable to do so

• Excludes medications prescribed by a physician, physician's assistant, dentist, or other medical professional from the definition of "drugs"

• The Department of Motor Vehicles must make the affidavit available online, and submission of a signed affidavit is required to be eligible for an instruction permit or minor driver's license
