SB 12-060 Summary

• State Department must submit annual written reports to legislature by January 15 each year beginning in 2013 detailing Medicaid client fraud investigations, benefit terminations, district attorney actions, recoveries, and fraud trends.

• Attorney General must submit annual written reports to legislature by January 15 each year beginning in 2013 documenting Medicaid provider fraud investigations, criminal complaints, convictions, civil claims, recoveries, and fraud trends.

• Changes recovery distribution for fraudulently obtained medical assistance funds so county receives all remaining funds after federal government receives its proportionate share of federal funds paid, eliminating the state's previous share.

• Increases executive director's office appropriation by $5,216 and 0.1 FTE (funded equally by general fund and federal funds) and decreases medical services appropriation by $54,156 for fiscal year 2012-2013.

• Act takes effect August 8, 2012, unless subject to referendum petition, in which case it requires voter approval at the November 2012 general election.
