Requires charter schools initially chartered on or after August 6, 1997, to organize as nonprofit corporations by July 1, 2013, maintaining their public school status.

Prohibits local boards of education from approving charter applications submitted by for-profit entities or from directly contracting with for-profit entities to operate charter schools, effective upon passage.

Bars local boards of education from renewing charters held by for-profit entities, either solely or in cooperation with other entities, beginning September 1, 2012.

Permits charter schools and institute charter schools to contract with education management providers (for-profit, nonprofit, or not-for-profit) provided the charter school maintains an independent governing board.

Imposes the same for-profit restrictions on institute charter schools, including nonprofit organization requirements by July 1, 2013, and prohibitions on approving or renewing for-profit charter contracts.
