SB12-068 Summary

• Public schools, district charter schools, and boards of cooperative services must prohibit industrially produced trans fats in all foods and beverages made available to students during school days and extended school days, effective September 1, 2013.

• The prohibition applies to foods in cafeterias, school stores, vending machines, and all other food service entities on school grounds, including foods used in preparation of student meals and beverages.

• Exemptions include foods from United States Department of Agriculture meal programs, student/teacher/parent fundraising efforts, and foods donated for off-campus consumption.

• The State Board of Education and State Charter School Institute may promulgate rules necessary for administration and enforcement of the restrictions.

• The bill appropriates $6,800 from the general fund to the Department of Education for fiscal year 2012-2013 to allocate to federal nutrition programs for consulting services related to implementation.
