SB12-069 Summary

• Extends the statute of limitations to 6 years for civil actions to recover debts for care given or delivered, services rendered, money lent, money paid, money had and received, goods sold and delivered, or open or book accounts.

• Clarifies that disputes or challenges to the reasonableness of amounts sought do not convert the debt from liquidated to unliquidated for statute of limitations purposes.

• Maintains a 1-year statute of limitations exception for actions to recover pursuant to section 38-35-124.5(3), C.R.S.

• Takes effect 90 days after final adjournment of the 2012 general assembly (August 7, 2012), subject to referendum petition and voter approval if challenged.
