SB 12-070 Summary

• Enacts the "Uniform Residential Landlord and Tenant Act" establishing comprehensive provisions governing rental agreements, landlord disclosures, tenant rights, and remedies for noncompliance.

• Requires landlords to provide tenants with written or electronic copies of rental agreements and disclose in writing the name and address of the property manager and owner or authorized agent for service of process.

• Establishes landlord access rights allowing entry with 48 hours' written notice for inspections, repairs, and showings, with emergency entry permitted without consent if reasonable; prohibits harassment and allows tenants to seek injunctive relief for unlawful entry.

• Modifies security deposit law by capping total deposits at one month's periodic rent, requiring return within one month after lease termination or premises surrender, and eliminating the 7-day notice requirement for tenants filing legal proceedings.

• Takes effect September 1, 2012, subject to referendum petition; applies to rental agreements entered into, extended, or renewed on or after the effective date.
