Agencies are prohibited from adopting rules unless they find the rule is consistent with the clear legislative intent of the general assembly as supported by committee hearings, floor debates, and public statements by principal sponsors or proponents.

Adds a new ground for the Committee on Legal Services and Office of Legislative Legal Services to use when reviewing executive branch agency rules: rules shall not extend in scope or impact beyond the clear legislative intent as documented in the public record.

Changes the term "regulation" to "rule" in existing rule-making procedure standards and adds new subsection (VI) to the adoption requirements in Colorado Revised Statutes 24-4-103(4)(b).

Act takes effect 90 days after adjournment of the 2012 general assembly (August 7, 2012) unless subject to a referendum petition requiring voter approval in November 2012.

Applies only to rules adopted by executive branch agencies on or after the effective date of the act.
