Repeals Colorado Revised Statute 18-13-105, which criminalized knowingly publishing statements tending to blacken the memory of the dead or damage the reputation of the living.

Eliminates the criminal libel offense that previously applied to written instruments, signs, pictures, or similar publications exposing individuals to public hatred, contempt, or ridicule.

Removes the affirmative defense provision that allowed criminal libel charges if a statement was false, except for libels about the dead or exposing natural defects of the living.

Takes effect September 1, 2012, unless a referendum petition is filed within 90 days after final adjournment of the legislature, in which case the act requires approval by voters at the November 2012 general election.
