Senate Bill 12-133 Summary

• Establishes the "Electronic Recycling Jobs Act" creating a statewide ban on disposing electronic devices or components in landfills effective July 1, 2013.

• Counties without at least two annual electronic waste recycling events or ongoing programs may request two-year exemptions from the landfill ban upon making good-faith efforts to secure recycling services.

• Requires state agencies to recycle electronic devices using only recyclers certified to national environmental standards such as R2 or E-Steward, except for reuse processing by the Division of Correctional Industries.

• Provides immunity for recyclers from liability for personal or financial data left on devices unless the recycler acted in a grossly negligent manner, and for waste haulers and landfill operators who post conspicuous signs refusing electronic devices.

• Authorizes charitable organizations to refuse electronic device donations and establish surcharges for accepting them, and directs the Department of Public Health and Environment to coordinate public education about electronic device recycling.
