SB12-147 Summary

• Prohibits any person from intentionally communicating materially false information about election procedures, voter eligibility, time, place, or manner of voting within 90 days before an election with intent to deter or prevent voting.

• Establishes violation as a class 5 felony with punishment as provided in section 18-1.3-401, C.R.S.

• Requires district attorney or attorney general to immediately investigate credible reports of violations, undertake corrective actions, and prosecute as necessary.

• Directs attorney general to promulgate rules establishing corrective actions to mitigate effects of false election information dissemination.

• Requires attorney general to submit biennial reports to legislature within 90 days after each general election describing all alleged violations from prior 2 years, including date, type, geographic source, corrective actions taken, referrals to other agencies, and prosecution outcomes.
