HB 13-1019 - Regulatory Reform Act of 2013

• Enacts the "Regulatory Reform Act of 2013" to modify state agency enforcement of new regulatory requirements on small businesses with 500 or fewer employees.

• Defines "new rule" as any regulatory requirement in place for less than one year prior to enforcement, and "minor violation" as violations involving administrative or operational matters such as record-keeping that do not affect public or worker safety.

• Requires state agencies to develop and distribute fact sheets on new rules to small businesses, making information available in electronic form with notice of where to find it online.

• Mandates that for first-time minor violations of new rules by businesses with 500 or fewer employees, state agencies must issue a written warning and conduct educational outreach rather than impose penalties.

• Takes effect August 7, 2013, or upon voter approval in November 2014 if subject to a referendum petition.
