HB13-1037 Summary

• Limits public records copying fees to actual costs of providing the copy plus nominal additional costs necessarily incurred by the custodian in complying with requests under the Colorado Open Records Act (CORA).

• Requires custodians to use the least expensive means available when responding to copying requests, including assigning tasks to the lowest-paid employee capable of performing the work.

• Prohibits copying fees from reflecting time spent by custodians in determining whether records are subject to inspection or copying under CORA.

• Prohibits copying fees from reflecting time spent by public employees already receiving hourly wages or compensation for responding to CORA requests.

• Takes effect July 1, 2013, and applies to all record requests made on or after that date.
