HB 13-1058: Spousal Maintenance Guidelines

• Establishes statutory framework and advisory guidelines for determining spousal maintenance (alimony) awards in Colorado divorce proceedings to promote consistency across judicial districts.

• For marriages lasting at least 3 years with combined adjusted gross income up to $240,000, guideline maintenance equals 40% of higher-income spouse's monthly adjusted gross income minus 50% of lower-income spouse's income, capped at 40% of combined income.

• Guideline maintenance term ranges from 11 months (36-month marriage) to 120+ months (20+ year marriages), with marriages exceeding 20 years potentially receiving indefinite maintenance unless court makes specific findings for reduced terms.

• Courts must consider 12 statutory factors including parties' financial resources, lifestyle during marriage, marital property distribution, employment and employability, health, age, and contributions to the marriage.

• Allows maintenance in short-term marriages (under 3 years) when property distribution is insufficient for equitable result; permits courts to modify or terminate maintenance awards entered on or after January 1, 2014; effective date January 1, 2014.
