State Department or its designated agent shall conduct pre-enrollment and post-enrollment site visits of providers designated as moderate or high categorical risks to verify accurate information and compliance with federal and state enrollment requirements

State Department may waive pre-enrollment and post-enrollment site visits if Medicare or other federally designated entities conduct the inspections, as established by state board rules

Provider risk categories are designated pursuant to the Medicare program and federal regulations, or if not designated there, shall be established by state board rules

Medicaid-enrolled providers must permit Centers for Medicare and Medicaid Services or its agents and the State Department or its agents to conduct unannounced, on-site inspections of all provider locations

Payment for agents conducting on-site inspections shall not be based on any recoveries or payments received by the State Department from providers for violations discovered during inspections
