HB13-1093 Summary

• Requires all local government agencies to use competitive sealed bidding for procurement contracts involving supplies, services, or construction, except for contracts under $50,000 in aggregate annual expenditure.

• Exempts procurements from competitive sealed bidding requirements when the agency receives no bids, rejects all bids, or a responsible officer determines emergency conditions exist that threaten public health, welfare, or safety.

• Prohibits local government agencies from dividing procurements or disposal of supplies, services, or construction into multiple separate projects solely to evade the competitive sealed bidding requirement.

• Establishes legislative findings that competitive bidding requirements will increase competition, decrease taxpayer costs, and support local small business development and economic vitality.

• Takes effect August 7, 2013, subject to referendum petition and potential voter approval in November 2014.
