HB 13-1103 Summary

• Authorizes the Public Utilities Commission to establish an oversight program for the safety and security of rail fixed guideway systems under federal law (49 U.S.C. sec. 5330 and 5329).

• Exempts rail fixed guideway systems from the annual March 1 reporting requirement to the Department of Revenue that lists public utilities subject to PUC jurisdiction.

• Changes funding for rail fixed guideway system oversight from operator fees assessed by the PUC to general appropriations from the Public Utilities Commission Fixed Utility Fund, effective upon receipt of federal grant moneys under the Moving Ahead for Progress in the 21st Century Act.

• Contains conditional repeal provisions that trigger upon the Director of the Public Utilities Commission providing written notice to the Revisor of Statutes that federal grant funds have been awarded to the state.

• Takes effect August 7, 2013, unless subject to referendum petition, in which case it requires approval by voters at the November 2014 general election.
