HB13-1108 Summary

• Preserves fire protection district boundaries as they exist at the time annexation proceedings commence, preventing automatic boundary changes when a municipality annexes land within a district's service area.

• Requires fire protection districts to continue providing service and performing all duties for annexed residents as if the area had not been annexed.

• Does not prevent fire protection districts from modifying their boundaries through other legal means available under Colorado law.

• Adds requirement to annexation impact reports that municipalities must include a statement identifying effects of the annexation upon fire protection districts with overlapping service areas.

• Takes effect September 1, 2013, and applies only to annexations commenced on or after the effective date.
