HB13-1131: Prenatal Sex Nondiscrimination Act

• Prohibits performing an abortion knowing it is sought based on the sex of the child, making it a Class 2 felony with sentencing between the minimum and twice the maximum presumptive range for that felony classification

• Criminalizes coercing a sex-selection abortion through force or threat of force, as well as soliciting or accepting funds for performing such abortions

• Prohibits transporting a woman into Colorado for the purpose of obtaining a sex-selection abortion

• Defines "sex-selection abortion" as abortion undertaken to eliminate an unborn child of an undesired sex, with legislative findings citing concerns about female infanticide, sex discrimination, and unnatural sex-ratio imbalances

• Includes a potential five-year appropriation requirement to cover increased capital construction and operational costs for state correctional facilities resulting from increased periods of imprisonment
