HB 13-1149 Summary

• District courts must impose an indeterminate sentence of at least 25 years with a maximum of natural life on offenders convicted of sexual assault against children age 14 or younger who are at least 7 years younger than the offender.

• Applies to five categories of sexual offenses: sexual assault, sexual assault in the first degree (prior to July 1, 2000), sexual assault in the second degree (prior to July 1, 2000), sexual assault on a child, and sexual assault on a child by one in a position of trust.

• Offenders sentenced under these mandatory provisions are excluded from probation eligibility and must be sentenced to department of corrections custody.

• If a sex offender sentenced under this bill is released on parole, the parole board must keep the offender on parole for the remainder of their natural life and cannot discharge either the parole or incarceration sentence.

• The bill is declared necessary for the immediate preservation of the public peace, health, and safety.
