HB13-1217 Summary

• Increases parole eligibility requirement from 50% to 75% of sentence for persons convicted of vehicular homicide committed on or after July 1, 2013, if they have a prior serious driving offense conviction.

• Prior conviction triggers include vehicular homicide, vehicular manslaughter, driving under the influence, driving while ability impaired, driving with excessive alcoholic content, reckless driving, eluding a peace officer, or violations of Section 42-4-1601, C.R.S.

• Parole eligibility applies 75% of the imposed sentence less any earned time credits authorized pursuant to Section 17-22.5-405.

• Effective date is July 1, 2013, and applies only to offenses committed on or after that date.

• Includes a safety clause finding the act necessary for immediate preservation of public peace, health, and safety.
