Keeps individual educator evaluation reports and related public records confidential, accessible only to the evaluated educator, supervising officials, hearing officers, and courts reviewing board of education decisions.

Requires chief executive officer evaluation reports to be open for public inspection regarding performance on school district objectives, fiscal management, district planning, and personnel supervision.

Allows individuals reviewing nonprobationary teacher appeals under section 22-9-106 to access evaluation reports and related public records used in preparing those evaluations.

Permits school districts to collect and use educator performance ratings and student assessment data linked to individual educators for fulfilling legal duties, but prohibits publishing or disclosing this data in ways that identify individual educators.

Allows the Department to use collected data for bona fide research purposes when obtained through established protocols and conducted in compliance with the Family Education Rights and Privacy Act of 1974, while protecting individual educator identity.
