HB 13-1228 Summary

• Colorado Bureau of Investigation shall impose a fee on firearm purchasers for performing instant criminal background checks, not to exceed total direct and indirect costs incurred.

• All fee moneys collected shall be transmitted to the State Treasurer and credited to a newly created Instant Criminal Background Check Cash Fund for use in performing background checks.

• The State Treasurer may invest unexpended moneys in the fund, and any remaining funds at fiscal year-end shall stay in the fund; the Bureau shall use remaining funds to reduce future fees when practicable.

• Bureau shall report to the Joint Budget Committee annually beginning January 15, 2014 on full-time employees used for background checks and calculations used to determine the fee amount.

• General fund appropriations to the Department of Public Safety are decreased by $1,032,376 total, with the same amount appropriated from the new cash fund for fiscal year 2013-14, including funding for 15.0 full-time equivalent positions.
