HB 13-1252 Summary

• Creates the Petroleum Cleanup and Redevelopment Fund in the state treasury as a new enterprise fund separate from the existing Petroleum Storage Tank Fund.

• Fund revenue sources include civil penalties collected under section 8-20.5-107, public and private gifts and grants, legislative appropriations, and earned interest deposited by the state treasurer.

• Department of Oil and Public Safety may use fund moneys for administration, investigation, abatement actions, and corrective action plans for petroleum releases not covered by the Petroleum Storage Tank Fund, with a maximum payout of 50 percent of eligible cleanup costs or $500,000 per corrective action plan, whichever is less.

• Requires transfer of $5 million from the Redevelopment Fund to the State Highway Fund during fiscal year 2013-2014 for fire suppression system construction at the Eisenhower-Johnson Tunnels, with this transfer provision repealing effective July 1, 2014.

• Division of Oil and Public Safety must promulgate rules to implement the new fund provisions.
