Clarifies that a recorded document affecting real property title is not automatically invalid or defective merely because it omits a legal description, rejecting the absolute holding in the In Re Rivera case.

Establishes that the absence of a legal description may be considered in the totality of circumstances when determining validity, but is not by itself determinative of whether a document is valid or defective.

Applies retroactively to documents recorded or executed before or after the effective date of the statute.

Effective August 7, 2013, unless a referendum petition is filed, in which case the act requires voter approval at the November 2014 general election to take effect.
