Boards of Cooperative Services (BOCES) may act as local education agencies for participating members to apply for, receive, or administer grants from federal or state grant programs, except federal formula grant moneys unless permitted under the Elementary and Secondary Education Act of 1965.

BOCES must obtain approval from at least two member school districts through a board vote before applying for federal or state grant moneys on their behalf, and participating districts cannot separately apply for the same grants.

Member school districts that decline to participate in a BOCES grant application remain eligible to apply for the same federal or state grant moneys individually.

BOCES may apply to any department division for eligible federal and state grants, and all department divisions must treat BOCES as local education agencies and inform them of available grant opportunities.

The State Board may promulgate rules to establish processes and guidelines for BOCES to apply for state or federal grant moneys under this section.
