SB 13-014 Summary

• Provides criminal immunity to laypersons who administer opiate antagonists (naloxone) in good faith to persons experiencing opioid overdose events.

• Grants criminal immunity to licensed prescribers and dispensers of opiate antagonists, including protection from liability for outcomes resulting from layperson administration.

• Provides civil liability immunity for both laypersons administering opiate antagonists and for licensed prescribers/dispensers of these drugs.

• Prohibits licensing boards from disciplining health care practitioners (physicians, pharmacists, nurse practitioners, physician assistants, advanced practice nurses) who prescribe or dispense opiate antagonists in good faith to at-risk individuals or their family members/friends.

• Requires the Colorado pharmacy board to adopt rules by January 1, 2014 permitting pharmacists to dispense opiate antagonists to at-risk individuals or persons positioned to assist them, and appropriates $8,318 for implementation costs.
