Students who complete high school in Colorado are classified as in-state for tuition purposes if they attended a Colorado public or private high school for at least three years and are admitted to a Colorado institution within twelve months of graduation or GED completion.

Students without lawful immigration status must submit an affidavit stating they have applied or will apply for lawful presence as soon as eligible to receive in-state tuition classification.

Students without lawful immigration status are not counted as residents for any purpose except tuition classification, but remain eligible for College Opportunity Fund program participation and institutional or private financial aid.

Verification of lawful presence is not required for receipt of educational services or benefits from Colorado higher education institutions, including College Opportunity Fund participation and college savings plans.

The bill contains no new appropriation, with the General Assembly determining any fiscal impact from increased College Opportunity Fund stipends will be offset through the supplemental appropriations process.
