SB13-035 Summary

• Prohibits governmental entities from issuing traffic citations based on evidence gathered through automated vehicle identification systems on highways, roads, or streets

• Creates exceptions allowing automated systems to assess tolls and issue citations for high occupancy vehicle and toll lane violations, and to assess tolls and civil penalties for toll roads and highways

• Prohibits evidence obtained from automated vehicle identification systems from being reported to the Department of Motor Vehicles, credit reporting agencies, or insurance companies

• Repeals provisions that allowed automated vehicle identification system violations to be considered outstanding judgments or warrants for purposes of driver's license suspension or denial

• Effective date is August 7, 2013, or following voter approval if a referendum petition is filed
