SB13-048 Summary

• Authorizes counties and municipalities to expend Highway Users Tax Fund (HUTF) revenues on transit-related projects, including public transportation, bicycle lanes, pedestrian infrastructure, and multimodal transportation system integration.

• Counties may expend up to 15% of their HUTF allocation for transit-related operational purposes, with the remaining allocation limited to planning, designing, engineering, construction, maintenance, and administration of transit projects.

• Municipalities may expend up to 15% of their HUTF allocation for transit-related operational purposes, subject to the same restrictions as counties on project types.

• Transit funding is classified as maintenance and supervision of public highways because it reduces traffic congestion, thereby reducing wear and tear on highways and bridges while improving their safety and reliability.
