SB13-056: Prenatal Sex Nondiscrimination Act

• Criminalizes performing an abortion knowing it is sought based on the sex of the child, with violations classified as a Class 2 felony punishable between the minimum and twice the maximum presumptive range.

• Prohibits coercion of sex-selection abortion through force or threats of force, solicitation or acceptance of funds for sex-selection abortions, and transporting a woman into Colorado to obtain a sex-selection abortion.

• Defines "sex-selection abortion" as an abortion undertaken for purposes of eliminating an unborn child of an undesired sex, with limited exceptions for abortions intended to save the mother's life, preserve her health, remove a dead fetus, or remove an ectopic pregnancy.

• Contains extensive legislative findings citing evidence of sex-selection abortion practices in the United States, estimates of hundreds of millions of "missing" women worldwide due to sex-based discrimination, and opposition to the practice by medical organizations and international bodies.

• May require a five-year appropriation to cover increased capital construction and operational costs for state correctional facilities resulting from increased imprisonment periods under the new law.
