• Requires the Division of Administration of the Department of Public Health and Environment to follow specific procedures when proposing new or amended permit requirements for general permits related to water quality control.

• Division must prepare a statement of basis and purpose explaining the need for proposed requirements and present evidence supporting those requirements, including information on pollutant potential, available controls, environmental incidents, and permit violations.

• Division must provide public notice of proposed requirements and consider comments from affected parties before implementation.

• Upon request by an affected party, the division must consider and give due weight to a cost-benefit analysis prepared by a third-party analyst from an approved list, concerning requirements not already mandated by federal or state statute or rule, with costs paid by the affected party.

• Parties may appeal general permits issued under this section using the appeals process set forth in Section 24-4-105, C.R.S., though these procedures do not confer rule-making authority on the division.
