Adds new section 31-31-401(6) protecting the Fire and Police Pension Association and the Defined Benefit System Trust Fund from liability if an employer fails to properly enroll members in the plan.

Adds new section 31-31-802(3) providing the same liability protection to the Fire and Police Pension Association and the Death and Disability Trust Fund for employer enrollment failures.

Neither the Association nor the trust funds are obligated or liable to any person or employer for damages arising from an employer's failure to properly enroll its members.

Takes effect 90 days after final adjournment of the general assembly (August 7, 2013) unless a referendum petition is filed, in which case it requires voter approval at the November 2014 general election.
