SB13-113 Summary

• Department may expend custodial moneys in the Natural Resource Damage Recovery Fund without further appropriation for restoration, replacement, or acquisition of natural resources injured or destroyed by hazardous substance releases.

• Department must use fund moneys in a manner consistent with any judicial order, decree, or judgment governing use of particular recoveries credited to the fund.

• Department may accept moneys from public or private sources to repay loans to the Natural Resource Damage Recovery Fund from the Hazardous Substance Response Fund or General Fund, with the state treasurer crediting such moneys to the appropriate fund.

• State treasurer continues transfers to the Hazardous Substance Response Fund until $1,657,577 is reached and to the General Fund until $1,004,873 is reached, including both transfers and credits from paragraph (b.5).

• Subsection (4) repealing this provision is delayed from July 1, 2017 to July 1, 2020.
