SB 13-116 Summary

• Defines "forensic psychologist" as a licensed psychologist who is board certified in forensic psychology by the American Board of Professional Psychology or who has completed a fellowship in forensic psychology meeting criteria established by the American Board of Forensic Psychology.

• Authorizes courts to appoint forensic psychologists to assist psychiatrists in examining defendants and advising courts on mental health issues in insanity pleas and impaired mental condition defenses.

• Allows forensic psychologists to conduct court-ordered mental health examinations of defendants, with the same authority and procedures as psychiatrists in criminal cases.

• Permits forensic psychologists to testify as experts in trials and hearings concerning defendants' mental condition, including their conclusions based on medical records, laboratory reports, and psychological test results.

• Takes effect August 7, 2013, subject to voter approval through referendum petition filed within 90 days after final adjournment of the general assembly.
