The presumption can be overcome if the contractor or employee was performing a job function that would normally be performed by the buyer's own employees.

Clarifies that the presumption does not apply to injuries occurring on the buyer's premises, leaving statutory employer liability intact for on-site injuries.

Defines "statutory employer" as an employer responsible for paying workers' compensation benefits under the statute.

Declared necessary for the immediate preservation of public peace, health, and safety.
