SB 13-197: Domestic Violence Firearm Prohibition

• Courts must order persons convicted of domestic violence crimes or subject to qualifying domestic violence protection orders to refrain from possessing or purchasing firearms or ammunition for the duration of the order.

• Persons must relinquish any firearms or ammunition in their possession within 24 hours if served in court or 48 hours if served outside court, with courts able to extend deadlines up to 72 hours for firearms and 5 days for ammunition upon showing of inability to comply.

• Firearms or ammunition can be relinquished to federally licensed dealers, law enforcement agencies, or private parties who are legally permitted to possess them, with all private transfers requiring background checks.

• Persons must file receipts or written statements with the court within 3 business days of relinquishment; failure to do so constitutes a violation of the protection order and triggers an arrest warrant.

• Appropriates $45,742 and 0.8 FTE to the judicial department for implementation during the fiscal year beginning July 1, 2013.
